Settled Possession —

Glossary
Law of Contract-I

Settled possession is possession that has continued for some time with the owner's knowledge. In Krishna Ram Mahale v. Shobha Venkat Rao (1989), the Supreme Court held that a person in settled possession cannot be dispossessed by the owner except by recourse to law, even if that person had no right to remain on the property. The Court did not define the term in a fixed formula.

Krishna Ram Mahale v.

Real-life example

Anil has run a shop in a rented room for six years, and his lease has ended. The owner cannot break the shutter and put his stock on the street. The owner must file a suit to evict him.

Where you'll come across this

As used in Krishna Ram Mahale v. Shobha Venkat Rao (1989) and in the note on recovering possession of property (sections 5 to 8 of the Specific Relief Act, 1963).

Krishna Ram Mahale v. Shobha Venkat Rao (1989)

Common mix-up

Don't assume that the rule needs a suit under section 6. In Krishna Ram Mahale the Court applied it to a suit filed within a few weeks, and it said the rule does not depend on that section.
