Cloud on Title —

Glossary
Law of Contract-I

As used in Anathula Sudhakar v. P. Buchi Reddy, a cloud on title arises when some apparent defect in a person's title to property, or some prima facie right of a third party over it, is made out or shown. A suit for declaration is the remedy to remove it. A bare denial of title by a trespasser with no apparent title does not raise a cloud.

Anathula Sudhakar v.

Real-life example

The defendant bought the same vacant sites from the registered owner and denied the plaintiffs' title. Because the plaintiffs' title came through an unregistered oral gift, the Court said they could not simply sue for an injunction and needed a declaration suit.
