Mesne profits are the profits a person in wrongful possession of property actually received, or might with ordinary diligence have received from it, together with interest on those profits. They do not include profits due to improvements made by that person. Source: Section 2(12), Code of Civil Procedure, 1908, as set out in Fateh Chand v. Balkishan Dass.
After the sale fell through, Fateh Chand kept the bungalow. The Supreme Court ordered him to pay mesne profits at Rs 140 per month from 1 June 1949, with interest at six per cent.
As used in Fateh Chand v. Balkishan Dass (the final part of the judgment, on mesne profits).
Fateh Chand v.
