Vicarious liability is liability imposed on one person for the tort of another, without any personal fault on the part of the person held liable — it arises purely from a recognised relationship between the two, such as employer and employee.
In Pushpabai Purshottam Udeshi v. Ranjit Ginning & Pressing Co. (1977), an employer was held vicariously liable when its driver's negligent driving, during the course of his duties, caused a fatal accident — the employer was answerable even though it had not itself done anything wrong.
Pushpabai Purshottam Udeshi v.

Don't assume an employer escapes liability just because the employee disobeyed instructions or acted negligently. An unauthorised or careless mode of doing an authorised task still falls within the course of employment; only a "frolic of his own" — conduct wholly unconnected with the assigned work — takes the employee outside it.
