Negligence — నిర్లక్ష్యం
Negligence is the breach of a legal duty to take reasonable care, resulting in damage to the plaintiff. Unlike trespass, it is not actionable per se — the plaintiff must prove duty, breach, causation, and actual damage.
నిర్లక్ష్యం అంటే సహేతుకమైన జాగ్రత్త తీసుకోవాల్సిన చట్టపరమైన కర్తవ్యాన్ని ఉల్లంఘించడం, దీని ఫలితంగా వాదికి నష్టం కలగడం. అతిక్రమణ వలె కాక, ఇది per se దావా వేయదగినది కాదు — వాది కర్తవ్యం, ఉల్లంఘన, కారణత్వం, వాస్తవ నష్టాన్ని నిరూపించాలి.
A factory fails to inspect a corroded effluent valve for years. It fails, releasing untreated chemical waste into a stream used for drinking water downstream, causing illness. The affected villagers can sue in negligence, since the factory owed them a duty of care and breached the standard a reasonably prudent operator would meet.

Don't confuse negligence with strict or absolute liability. Negligence requires the plaintiff to prove the defendant fell below a reasonable standard of care; strict and absolute liability impose liability regardless of how much care was taken.
