Due diligence is the duty of a State to take reasonable steps to prevent harm from activities in its territory. A State that licenses, inspects and controls an activity with care meets the standard.
Due diligence
A State knows a tailings dam near its border is unsafe, yet does not inspect it. The dam bursts and poisons a river in the next country. The State failed in due diligence.
As used in the notes on State liability and transboundary pollution, for the standard of care a State owes to its neighbours.
Don't confuse due diligence with strict liability. Due diligence asks what the State did to prevent harm. Strict liability would make the State answer for any harm, whatever care it took.
