The no-harm principle says a State must not use its territory, or let it be used, to cause serious injury to another State. The Trail Smelter tribunal stated it for fumes crossing a border. Stockholm Principle 21 repeats it.
A smelter just inside one country sends sulphur dioxide fumes across the border and kills crops in the neighbouring country. The no-harm principle makes the first country answerable for letting this happen.
As used in the Trail Smelter Arbitration (United States v. Canada) and in Principle 21 of the Stockholm Declaration, 1972.
Trail Smelter Arbitration (United States v. Canada)
Don't assume every pollutant that crosses a border breaches the principle. The Trail Smelter tribunal required serious consequence and injury established by clear and convincing evidence.
