State Responsibility —

Glossary
Environmental Law

State responsibility is the legal duty of a State to answer for a breach of its obligations towards another State. In the Trail Smelter case, Canada was made to pay compensation and keep the smelter within set limits.

Real-life example

A mine licensed by one State leaks poison into a river that flows into a neighbouring State. The neighbouring State claims compensation from the licensing State, not from the mining company.
