Constitutional Morality — రాజ్యాంగ నైతికత (Constitutional Morality)

Glossary
Constitutional Law-I

A commitment to the values and procedures of the Constitution, such as liberty, equality, fraternity, dignity and the rule of law, over personal views, popular opinion or convenience. Dr Ambedkar, quoting George Grote, described it as "a paramount reverence for the forms of the constitution". The Supreme Court has held that it prevails over majoritarian public morality.

Real-life example

A community disapproves of two consenting adults living together. Under constitutional morality, the courts ask whether the Constitution's values protect the adults, and these values prevail over the community's disapproval.
