Nervous shock is a psychiatric or nervous injury caused without any physical impact, whether by a defendant's intentional conduct or by negligence, once it produces a recognisable physical or psychiatric consequence.

In Wilkinson v. Downton (1897), the defendant falsely told a woman, as a practical joke, that her husband had been badly injured; the shock made her violently ill, and the court held the defendant liable even though no physical contact was involved.

Don't assume every claim for nervous shock must be argued through negligence. Where the defendant intentionally causes the shock through words or conduct calculated to cause harm, as in Wilkinson v. Downton, liability rests on that intention alone — the plaintiff need not separately prove a breach of the duty of care that negligence requires.
