In tort law, malice has two distinct technical senses. "Malice in fact" (actual malice) means a lawful act done with real personal ill-will or spite. "Malice in law" (implied malice) means doing a wrongful act intentionally, without just cause or legal excuse — this is the sense tort law actually cares about, since malice in fact alone does not make a lawful act tortious.

In Bradford Corporation v. Pickles (1895), the defendant openly admitted he cut off a town's water supply purely to spite the corporation — pure malice in fact — yet he was not liable, because the underlying act (using water on his own land) was lawful.

Don't assume "malice" in a case always means the defendant loses. In most torts, proving personal spite (malice in fact) alone won't help you win if the act itself was perfectly lawful.
