Malicious prosecution is a tort committed by instituting unsuccessful criminal (or certain civil) proceedings against another, maliciously and without reasonable and probable cause, causing the person prosecuted damage.

Don't treat "malice" and "absence of reasonable and probable cause" as the same requirement — they are legally distinct, and both must be independently proved. A prosecution can be malicious in motive yet still supported by reasonable cause, in which case the claim fails; absence of reasonable cause alone does not automatically prove malice either.
