Deficiency is any fault, imperfection, shortcoming, or inadequacy in the quality or performance of a service, expressly including negligence and deliberate withholding of relevant information from the consumer.

Don't confuse "deficiency" (which applies to services) with "defect" (which applies to goods) — a lawyer giving poor advice is a service issue, but a phone that overheats is a goods issue, even though the underlying legal test (falling below a required standard) is structurally similar for both.
