As explained in this judgment, a contract "of personal service" (a "contract of service") is one where the person hiring the service keeps direct control and supervision over how the other person does the work. The test is whether, given the nature of the work, there was due control by the person contracting for the service. The greater that direct control, the stronger the case for calling it a contract of personal service, rather than a contract "for services" (professional services rendered independently). Section 2(42) of the Consumer Protection Act, 2019 excludes a "contract of personal service" from the definition of "Service".
Consumer Protection Act, 2019లోని Section 2(42), "Service" నిర్వచన నుండి "contract of personal service"ను మినహాయిస్తుంది.
In this case, an advocate conducting a client's litigation under a vakalatnama has to follow the client's instructions on the objectives of the case, cannot compromise a claim without express authority, and must not exceed the authority the client gives. The Court held that this degree of client control makes the advocate-client relationship a contract of personal service, so a "deficiency in service" complaint against the advocate could not go to a consumer forum.
