An act of God (vis major) is a species of inevitable accident caused specifically by the operation of natural forces, without any human intervention, and so extraordinary that no reasonable foresight or precaution could have guarded against it.

In Nichols v. Marsland (1876), an extraordinary and unprecedented rainfall — greater than any within living memory — caused the defendant's ornamental lakes to overflow and sweep away the plaintiff's bridges. The court held the defendant not liable, since the escape was caused by an act of God, not by any default in maintaining the reservoirs.

Don't treat every unexpected natural event as an act of God. Ordinary natural events that a person is expected to plan for — normal rainfall, routine tides, seasonal weather — do not qualify; the event must be exceptional and unprecedented in the circumstances, not merely inconvenient or unusual.
