Remission —

Glossary
Law of Contract-I

Remission means a promisee gives up, wholly or in part, his right to have a promise performed. Section 63 of the Indian Contract Act, 1872 lets every promisee dispense with or remit performance wholly or in part, extend the time for it, or accept any satisfaction he thinks fit instead.

Real-life example

A landlord tells his tenant, "Pay me Rs 8,000 and I will forget the other Rs 2,000 of rent." The tenant pays Rs 8,000. The landlord has remitted the Rs 2,000.

Where you'll come across this

As used in section 63 of the Indian Contract Act, 1872 (illustrations (a) to (e)), and in the note on remission as a mode of discharge of a contract.

Common mix-up

Don't confuse remission with novation. Remission creates no new contract, while novation replaces the old contract with a new one under section 62.
