As used in Kamal Gupta v. L.R. Builders, a non-signatory is a person who did not sign the agreement that contains the arbitration clause. Such a person is not a party under Section 2(h) of the Arbitration and Conciliation Act, 1996, and the Court called them a stranger to the arbitration.
Kamal Gupta v. L.R. Arbitration and Conciliation Act,
Rahul Gupta and several companies had not signed the family MoU/FSD. A court let them remain present in the arbitration between the signatories. The Supreme Court set this aside: the award would not bind them, and their presence would breach confidentiality under Section 42A.

Don't assume a non-signatory with a genuine worry can sit in as an observer. The Court held that even a well-intentioned direction allowing this has no statutory support; the non-signatory's remedy, if any, is under Section 36 when the award is enforced against it.
