Section 11 of the Hindu Marriage Act, 1955, as quoted in the judgment, makes a marriage solemnised after the Act's commencement null and void if it contravenes clause (i), (iv) or (v) of Section 5. Either party may seek a decree of nullity. The Court read void in Section 494 IPC in a wider sense.
The Court said a marriage solemnised by a Hindu husband after embracing Islam may not strictly be void under the Act, because he is no longer Hindu. It still held the marriage void in the wider sense used in Section 494 IPC.
