The devolution of a deceased person's property according to the terms of a valid will they left behind, taking priority over the ordinary intestate rules.

మరణించిన వ్యక్తి వదిలివేసిన చెల్లుబాటయ్యే వీలునామా నిబంధనల ప్రకారం ఆయన ఆస్తి బదిలీ కావడం, ఇది సాధారణ వీలునామా-రహిత నియమాల కంటే ప్రాధాన్యత కలిగి ఉంటుంది.

Real-life example

Sunita leaves a registered will bequeathing her flat to her niece instead of her legal heirs under Section 15 — because she made a valid will, testamentary succession governs, and the flat goes to the niece.

Where you'll come across this

Section 30 of the Hindu Succession Act preserves this right, and the actual mechanics of making a valid will come from the Indian Succession Act, 1925 — both covered in the Notes post on testamentary succession in this subject's Unit V.

Common mix-up

Don't assume a coparcener could always will away joint family property — before 1956, an undivided coparcenary interest could not be bequeathed at all; the Explanation to Section 30 changed this specifically for Hindu coparceners.
