Severance of status is the first stage of partition — a purely legal change ending a coparcener's joint status. Under Addagada Raghavamma v. Addagada Chenchamma (1964), it is a matter of individual volition, effected by a clear, unequivocal declaration of intent to separate, once that declaration is communicated to the other affected coparceners.

Real-life example

Filing a partition suit is, by itself, treated as such a declaration — the moment it reaches the other coparceners, that coparcener is no longer part of the coparcenary, even before any property changes hands.

Common mix-up

A private, uncommunicated intention — even if clearly written down, such as in a will — does not by itself cause severance; the declaration must actually reach the other coparceners.
