Preponderance of Probabilities —

Glossary
Family Law-I

Preponderance of probabilities is the civil standard of proof. A fact is proved if the court believes it exists, or finds it so probable that a prudent person would act on the belief that it exists. Source: section 3 of the Evidence Act, as explained in Dastane v. Dastane, 1975.

Real-life example

The High Court required the husband to prove cruelty beyond reasonable doubt. The Supreme Court held that this was wrong. It held that cruelty in a petition under the Hindu Marriage Act is proved on a preponderance of probabilities.

Where you'll come across this

As used in Dastane v. Dastane (Court's Reasoning, on the standard of proof).

Common mix-up

Don't assume that a matrimonial petition needs proof beyond reasonable doubt because marriage matters to society. The Court said that this view may call for the clearest proof, but it does not change the standard of proof.
