Pious Obligation — పుణ్య బాధ్యత

Pious obligation is a Mitakshara doctrine under which a son is religiously bound to pay off his father's lawful (vyavaharika) personal debts out of joint family property, even without personal benefit or consent. Since the 2005 amendment, it no longer applies to debts contracted on or after 20 December 2004.

Real-life example

A father borrows money before 2004 for a legitimate business venture and dies without repaying it. His son can be made to repay it out of joint family property, even though the son never signed for or benefited from the loan.

Common mix-up

Pious obligation is not the same as Karta's "legal necessity" power — a father's antecedent debt doesn't need to relate to family necessity at all, only to not be avyavaharika (illegal or immoral).
