An antecedent debt is a father's own personal debt that is prior in time and independent in fact from any later transaction used to discharge it. Under Brij Narain v. Mangla Prasad (1924), a father may alienate joint family property to pay off such a debt, binding his sons' shares too, provided the debt is not avyavaharika.
A father borrowed money two years ago for his own use. He now mortgages joint family land specifically to repay that old loan — since the debt is genuinely older and separate from the mortgage, it binds his sons too.
Debts and Alienation of Property.
A debt raised in the same breath as the very mortgage meant to "pay" it doesn't count as antecedent — it must be a genuinely separate, prior transaction, not part of the challenged one.
