A legal fiction under which a deceased coparcener's share in joint family property is calculated as though an actual partition had taken place immediately before his death, so that his individual share alone can pass under the ordinary rules of succession.
When Khandappa, a coparcener, dies leaving a widow and sons, the courts first work out what his share would have been had the family actually partitioned the day before he died — that computed share is his notional partition share.
Central to Section 8's application to coparcenary property, and to Gurupad Khandappa Magdum v. Hirabai Khandappa Magdum (1978) — both covered in the Notes post on succession to a Hindu male's property in this subject's Unit V.
A notional partition is not an actual, physical division of property — no property is really split up; it's purely a computational step used to isolate the deceased's own share for the purposes of Section 8.
