This is the 1st post in Environmental Law, Unit V — this unit studies the international regime for protecting the environment; this post introduces transboundary pollution, the problem that makes a purely domestic environmental law (of the kind studied in Units II and III) insufficient on its own.
Everything studied so far in this subject — the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, and the writ jurisdiction of Indian courts — operates within one country's borders. Each of these mechanisms assumes a single sovereign with the power to legislate, a set of courts with jurisdiction to enforce that legislation, and a polluter and a victim who are both, in the end, answerable to the same legal system. Pollution, however, does not respect the line drawn on a map. Smoke from a factory near a border can drift into the neighbouring country; a river that rises in one country and flows through another carries whatever is dumped into it upstream; radioactive fallout from a nuclear accident travels wherever the wind carries it; and gases that deplete the ozone layer or warm the atmosphere do not stay within the country that emitted them at all — they affect the whole planet. None of India's domestic pollution-control statutes can bind a foreign polluter, and no Indian court can ordinarily issue an enforceable order against a person or company operating entirely outside India's territory. Transboundary pollution is the name for this category of harm, and it is the starting point for the whole of this unit, because it is precisely the situation for which domestic environmental law has no answer, and for which a separate body of international environmental law had to be built.
Transboundary pollution refers to pollution that originates from a source (natural or human-made) situated within the territory or control of one State, and causes, or threatens to cause, environmental harm within the territory of another State, or in areas beyond the limits of any State's national jurisdiction, such as the high seas or the upper atmosphere. It is useful to separate this into two broad patterns. The first is point-to-point transboundary pollution, where the source and the effect are both identifiable and reasonably close together — the classic example is smoke or fumes from a factory near an international border drifting across it, or pollutants discharged into a river in an upstream country affecting water quality in a downstream country. The second is diffuse or global transboundary harm, where the pollutant mixes into a shared global medium — the atmosphere or the oceans — before it causes harm, so that no single country's emissions can be traced to a specific injury in a specific other country. Ozone-depleting substances and greenhouse gases causing climate change fall into this second category; they are transboundary in the sense that every country's emissions contribute to a harm suffered by every other country, but the causal link between any one source and any one effect is diffuse rather than direct.
Trail Smelter Arbitration (United States v. Canada) (1938 & 1941) — decided by an ad hoc Arbitral Tribunal of Jan Frans Hostie, Charles Warren and Robert A. E. Greenshields.
Relevance here: When sulphur dioxide fumes from a Canadian lead-zinc smelter drifted across the border and damaged crops and forests in the American state of Washington, the Tribunal held that no State has the right to use or permit the use of its territory in a manner that causes serious, provable injury to the territory of another State — the founding statement of the "no-harm" principle that underlies this entire topic.
Several well-documented incidents illustrate the different forms transboundary pollution can take. The Chernobyl nuclear disaster of 26 April 1986, in what was then the Soviet Union (present-day Ukraine), released a radioactive plume that spread across large parts of Europe within days, depositing measurable radioactive contamination on agricultural land in Scandinavia, Central Europe and beyond, illustrating how a single accident within one country's territory can cause harm across an entire continent almost instantly. Long-running acid rain disputes in Europe and North America through the 1970s and 1980s — where sulphur dioxide and nitrogen oxides emitted by power plants and industry in one country fell as acid rain in a neighbouring country, damaging forests, lakes and buildings — led directly to the 1979 Convention on Long-Range Transboundary Air Pollution under the UN Economic Commission for Europe. Seasonal transboundary haze, caused by large-scale agricultural and forest fires in Indonesia, has for years affected air quality across Malaysia and Singapore, prompting a regional ASEAN agreement on the subject. Each of these examples shares the same structure: an activity that is lawful, or at least not directly prohibited, within the territory where it occurs, but which produces harmful effects in a State that had no say in permitting it.
A victim of transboundary pollution cannot simply approach a court in the polluting country in the way an Indian citizen approaches an Indian court under Article 32 or Article 226 — that victim is a foreign national, often without standing, resources, or even legal capacity to sue in a court whose language, procedure and substantive law are unfamiliar. Nor can the victim's own home State's courts issue an order that binds a defendant and its assets located entirely in another sovereign country; a domestic court's writ simply does not run beyond its own State's borders. This is why transboundary pollution has historically been addressed, if at all, through State-to-State diplomacy, bilateral or multilateral treaties, and — as in Trail Smelter — international arbitration between the two governments themselves, rather than through litigation by the individual victims. The remaining posts in this unit trace how this originally ad hoc, case-by-case approach gradually developed into a structured international regime of declarations, conventions and institutions.
Suppose a large coal-fired power plant is built just inside Country A, close to its border with Country B, and its emissions of sulphur dioxide begin falling as acid rain on Country B's forests and lakes, killing fish and damaging trees over several years. Country B cannot send its own pollution-control inspectors into Country A to shut the plant down, and a private landowner in Country B whose forest has died cannot ordinarily sue the power company in Country A's courts with any realistic chance of success. What Country B can do is raise the matter diplomatically with Country A, invoke the customary international law "no-harm" principle recognised since Trail Smelter, and — if diplomacy fails — seek international arbitration or refer the dispute to an appropriate international tribunal, much as the United States did against Canada in 1935. This is exactly the structural gap that the rest of this unit's conventions and institutions were built to close.
