Glossary
Environmental Law

An adjudicating officer is an officer appointed under an environmental law to decide the amount of a monetary penalty for a contravention. In the Environment (Protection) Act, 1986 and the Biological Diversity Act, 2002 the penalty is decided by this officer instead of a criminal court.

Real-life example

A company breaks a rule under the Environment (Protection) Act, 1986 and no other penalty is provided. The adjudicating officer decides a penalty between Rs 10,000 and Rs 15 lakh, as section 15 allows.
