In Part III, "the State" includes the Government and Parliament of India, the Government and the Legislature of each State, and all local or other authorities within the territory of India or under the control of the Government of India (Article 12). Fundamental Rights are claimed against the State as so defined.
The Union Government is the State. A Union rule that takes away a Fundamental Right is therefore tested under Article 13(2), where "law" includes a rule or regulation.
As used in the note on Definition of State, which studies Article 12 and the tests for "other authorities".
