Right to Livelihood —

Glossary
Constitutional Law-I

The right to livelihood is the right to the means of earning a living. As recorded in L.I.C. of India v. Consumer Education and Research Centre, a Constitution Bench in Olga Tellis held that the right to life includes the right to livelihood. Without it, the right to life would be easily abrogated. The Court reads Articles 39(a) and 41 beside Article 21 when it reaches this result.

L.I.C. of India v.

Real-life example

A pavement dweller in a city sells vegetables near a market. The authority wants to remove the stall. The Court, applying this right, expects fair procedure before removal.
