Non-justiciable describes a provision that no court can enforce. Article 37 says the provisions of Part IV shall not be enforceable by any court. So a person cannot ask a court for an order that forces the State to carry out a Directive Principle. The principles are still described as fundamental in the governance of the country.
A village has no free school. A parent asks the High Court to order the State to open one, relying only on a Directive Principle in Part IV. Article 37 bars the court from enforcing that principle by itself.
As used in Article 37 and in the note on Directive Principles of State Policy (Legal provision).
Directive Principles of State Policy
