Torture, rape, assault or death inflicted on a person while held in the custody of the police or another government agency. The Supreme Court has called it "a naked violation of human dignity" and "perhaps one of the worst crimes in a civilised society governed by the Rule of Law."
D.K. Basu v. State of West Bengal arose from newspaper reports of deaths in police lock-ups across India. The Supreme Court held that such custodial violence infringes Article 21, and that the State must pay compensation for it in its public-law jurisdiction, besides laying down eleven mandatory requirements for every arrest and detention.
D.K. Basu v. State of West Bengal కేసు ఉద్భవించింది.

D.K. Basu v. State of West Bengal (Anand, J.,
Don't assume a custodial-violence complaint only gives the victim a private tort suit. D.K. Basu held that compensation for an established violation also lies in public law under Articles 32 and 226, and that sovereign immunity is no defence to that public-law claim.
