(Catch-Up Rule)

Glossary
Constitutional Law-I

The rule that a reserved-category employee who gets an accelerated (roster-point) promotion does not thereby gain seniority over a senior general-category employee who is promoted later to the same grade. Once the general-category employee is promoted, they "catch up" and regain their seniority over the earlier-promoted candidate.

Real-life example

In M. Nagaraj v. Union of India, the Court traced the catch-up rule to Union of India v. Virpal Singh Chauhan, where Railway Guards promoted early through the reservation roster did not get seniority over general-category Guards later promoted to the same grade. The Court held the catch-up rule is not implicit in Article 16, so Parliament could validly reverse it by the Eighty-Fifth Amendment, which added consequential seniority instead.

M. Nagaraj v. Union of India కేసులో, క్యాచ్-అప్ రూల్‌ను కోర్టు Union of India v.
