Seniority in the promoted grade that a reserved-category employee carries forward from an earlier accelerated (roster-point) promotion, so that they keep ranking above a general-category employee who is promoted later, even after that employee also reaches the same grade. It is the opposite of the catch-up rule.
The Constitution (Eighty-Fifth Amendment) Act, 2001 added the words "with consequential seniority" to Article 16(4A), retrospectively from 17 June 1995. M. Nagaraj v. Union of India upheld this as a valid, enabling change, since consequential seniority is a service-jurisprudence concept, not a constitutional requirement, and the amendment did not obliterate backwardness, inadequate representation or overall efficiency as conditions on its use.
M. Nagaraj v.
