The State action doctrine is an American theory. Under it, private activity that is aided, facilitated or supported by the State in a significant measure takes the colour of State action. It then faces the same constitutional limits as the State. Source: M.C. Mehta v. Union of India.
In the Oleum Gas Leak Case, the applicants relied on this doctrine to argue that Shriram, a private company, was subject to Article 21. The Court said the American history of the doctrine is irrelevant to India. It added that only the principle behind it, to the limited extent it can be Indianised, is of interest.
