Servient Tenement — భారం మోసే ఆస్తి

As used in Sturges v. Bridgman, the servient tenement is the land of the person against whom an easement is claimed. Here it was the physician's land.

Real-life example

The Court said consent of the owner of the servient tenement lies at the root of prescription. The physician could not consent to something he had no power to prevent.
