Nuisance is an unlawful, indirect interference with a person's use or enjoyment of land, or of some right connected with it — arising from consequences such as noise, smoke, or smell that cross onto the land, rather than from a direct physical entry.
In St Helens Smelting Co. v. Tipping (1865), fumes from a copper-smelting works damaged trees and crops on a neighbouring estate; the House of Lords held the defendant liable, since material injury to property is actionable regardless of the industrial character of the area.
St Helens Smelting Co. v.
The subject of Unit 3, Post 6, which splits into private nuisance and public nuisance depending on who is affected.
Don't assume that taking reasonable care while carrying on an activity is a defence to nuisance. Nuisance looks at the result of the interference, not the care taken to prevent it — a defendant can still be liable even after exercising every reasonable precaution, if the interference remains substantial and unreasonable.
