False Imprisonment —

Glossary
Law of Torts

False imprisonment is the total restraint of a person's liberty, without lawful justification, for however short a time — a partial obstruction of one route, while a reasonable alternative remains open, is not enough.

Real-life example

In Rudal Shah v. State of Bihar (1983), a man acquitted by the Sessions Court was illegally kept in jail for over 14 years due to administrative negligence; the Supreme Court awarded him compensation under Article 32 for this prolonged illegal detention.

Rudal Shah v.

Common mix-up

Don't assume blocking someone's chosen path is always false imprisonment. In Bird v. Jones (1845), blocking one route across a bridge while leaving another open was held NOT to be false imprisonment, since imprisonment requires total restraint in every direction, not partial obstruction of one path.

Bird v.
