Binding Precedent —

Glossary
Law of Torts

A binding precedent is an earlier decision that a later court must follow. As used in this case, a Supreme Court Bench decision binds a later Bench of the same or smaller strength. A Bench that disagrees must follow the earlier decision or refer the matter to a larger Bench.

Real-life example

In Santosh Devi, a two-Judge Bench disagreed with Sarla Verma, a decision of a coordinate Bench. The Constitution Bench said it should have referred the matter to a larger Bench (paras 15-20, 61(i)).
