Assault — దాడి బెదిరింపు

Assault is an act of the defendant that causes the plaintiff a reasonable apprehension of the infliction of imminent unlawful force on their person — it is complete the moment that apprehension is created, whether or not any actual contact ever follows.

Real-life example

In Stephens v. Myers (1830), the defendant advanced towards the chairman of a meeting with a clenched fist, climbing over chairs to reach him, but was stopped before making contact. He was still held liable for assault, since he had the apparent means and immediate intention to strike.

Common mix-up

Don't confuse assault with battery. Assault needs no physical contact at all — only a reasonable apprehension of imminent contact, which the plaintiff must actually perceive. Mere words alone, without any accompanying gesture or act, are traditionally not enough to found an assault.
