Glossary
Law of Contract-I

As used in Felthouse v. Bindley, the statute of frauds is the statute 29 Car. 2, c. 3, as quoted in the judgment. Its 17th section said no contract for the sale of goods was good unless a note or memorandum in writing was made and signed by the parties to be charged.

Felthouse v.

Real-life example

Paul Felthouse wrote to his nephew about buying a horse, and the nephew never answered him. One ground of the rule nisi was that there was no sufficient memorandum in writing, possession of the horse or payment to satisfy the statute of frauds. The Court decided the case on another ground: no acceptance had bound the nephew.
