Law of Contract-I

As used in Niranjan Shankar Golikari v. Century Spinning and Mfg. Co. Ltd., severance means separating the good part of a covenant from the bad part. The Court held that the rule against severance applies only where the covenant is bad in law. Where the negative stipulation is not void, the court can grant a limited injunction to the extent needed to protect the employer.

Niranjan Shankar Golikari v. Century Spinning and Mfg.

Real-life example

The appellant argued that the terms of the clause were too wide and that the court could not sever the good from the bad. The Court rejected this and upheld an injunction limited in time, nature of employment and area.
