Nonsuit —

Glossary
Law of Contract-I

As used in Felthouse v. Bindley, a nonsuit is a court order ending the plaintiff's case. A verdict had been found for the plaintiff. The Court still ordered a nonsuit, because the plaintiff had no property in the horse when it was sold.

Felthouse v.

Real-life example

A verdict was found for the plaintiff with damages of 33l. The trial judge had reserved leave for the defendant to move to enter a nonsuit. The Court of Common Pleas made the rule to enter a nonsuit absolute.

Court of Common Pleas, nonsuit
