Limitation Period —

Glossary
Law of Contract-I

The limitation period is the time within which a suit must be filed under the Limitation Act. In this case Article 91 and Article 95 each gave three years to sue to set aside an instrument. The clock started when the facts or the fraud became known to the plaintiff.

Real-life example

Ningawwa learned of the fraud in her gift deed only after her husband died. She sued within a few days, so her suit on the Lingadahalli plots was within time under Article 95.
