Instantaneous Communication —

Glossary
Law of Contract-I

As used in Entores Ltd v Miles Far East Corporation, instantaneous communication means talking or messaging so fast that it is virtually immediate, as with the telephone or Telex. The Court of Appeal held that the postal rule does not apply to it; the contract is complete only when the acceptance is received by the offeror.

దీనికి postal rule వర్తించదని Court of Appeal చెప్పింది; offeror acceptance అందుకున్నప్పుడే కాంట్రాక్ట్ పూర్తవుతుంది.

Real-life example

The English buyer in London and the Dutch company in Amsterdam exchanged offers and acceptances by Telex machines. The Court said the contract was made in London, where the acceptance was received.
