As used in Gujarat Bottling Co. Ltd. v. Coca Cola Co., a franchise is a permission to manufacture, bottle and sell goods covered by another's trade marks, on the terms laid down in the agreement. The Court called the 1993 Agreement an agreement for grant of a franchise. It held that a condition against dealing in competing goods, in such an agreement, cannot be regarded as in restraint of trade.
Gujarat Bottling Co. Ltd. v.
Coca Cola let GBC make, bottle, sell and distribute drinks under the marks Coca Cola was about to acquire, in Ahmedabad and Rajkot, to Coca Cola's formula and standards. The Court treated this as a franchise.
