Error Apparent on the Face of the Award —

Glossary
Law of Contract-I

An arbitrator's award can be set aside for an error on its face only when the award, or a document incorporated with it, states a legal proposition that is the basis of the award and is erroneous. Source: Alopi Parshad and Sons Ltd. v. Union of India. This does not apply when a specific question of law was referred to the arbitrator.

Alopi Parshad and Sons Ltd. v. Union of India.

Real-life example

The contract fixed the rates for establishment and contingencies. The arbitrators still awarded more. The Court held that award wrong on its face, because the arbitrators ignored the express terms of the contract.
