Desuetude —

Glossary
Law of Contract-I

As used in Gherulal Parakh v. Mahadeodas Maiya, desuetude means falling out of use. The Court held that the Hindu law texts condemning gambling were not legally enforced and fell into desuetude, so they gave no ground of public policy against wagers.

Gherulal Parakh v.

Real-life example

Ancient texts condemned gambling, but Indian courts did not enforce them and no recorded case held wagers illegal on that ground. The Court treated the texts as having fallen into desuetude.
