Deceit —

Glossary
Law of Contract-I

As used in Derry v. Peek, an action of deceit is a common law action for damages against a person whose false statement induced the plaintiff to act. It needs proof of fraud; a false statement alone is not enough.

Derry v.

Real-life example

A shareholder sued five directors for deceit over a prospectus statement. The House of Lords held that the directors honestly believed the statement, so there was no fraud and the action failed.

Where you'll come across this

As used in Derry v. Peek (Lord Herschell's opinion; Lord FitzGerald's opinion). The judgment says such an action differs from an action to rescind a contract for misrepresentation.

Derry v.
