Pre-nuptial Agreement —

Glossary
Family Law – I (Hindu Law)

An agreement made before or at the time of a marriage. In the Tikait case, the Calcutta High Court dealt with one that controlled the rights the law gives the parties after the marriage. Ghose, J. said such an agreement "would seem" opposed to public policy if enforcing it might make the marriage itself nugatory (useless) or infructuous (fruitless) (para 38). He held this agreement opposed to public policy (para 40).

Real-life example

At the time of a marriage in 1885, the husband's parents and the husband signed a deed. It said he would live for ever in his wife's family house and could never take her elsewhere. The Court held the deed was no answer to his suit for enforcement of conjugal rights.
