Legal Fiction — న్యాయపరమైన కల్పన

As used in paras 100-101, a rule of law that assumes facts for a set purpose. The Court applies it only for that purpose and not beyond.

ఒక నిర్దిష్ట ప్రయోజనం కోసం ఏదైనా నిజమని భావించే చట్టనియమం. కోర్టు దానిని ఆ ప్రయోజనానికే వర్తింపజేస్తుంది, అంతకుమించి కాదు.

Real-life example

The Court held that the deemed partition in old section 6 was a legal fiction only to find the share of a deceased coparcener. It did not disrupt the coparcenary (paras 100 and 101).
