As used in this case, the standard on which a court decides when no rule of law applies. The Court said the conduct of a spouse who converts is judged by justice, equity and good conscience. The judgment does not give its own definition.

The Court held that a dispute between a convert to Islam and a non-Muslim spouse is not one where the parties are Muslims. So the Court decides by justice, equity and good conscience, and the second marriage violates that standard.
